Local Development Plan - privacy notice

Read the privacy notice for the Local Development Plan (LDP).

Our Local Development Plan (LDP) sets out policies and proposals for the use, development and protection of land within East Renfrewshire. The current plan was adopted on 31st March 2022 and is in the process of being replaced. You can find more details about the LDP process on our ldp3 web page.

Consultation is a statutory duty of the local authority for the LDP.  As part of the preparation of LDP you may provide us with information about you. This may be either because you want to be informed about updates to the LDP or because you have made comments at some stage in the development plan's process.

Data protection legislation sets out the lawful basis for processing personal data and for the purposes of the LDP Consultation our lawful basis for processing personal data is:

1. Legal obligation - the processing is necessary for us to comply with the law

2. Public task - the processing is necessary to perform a task in the public interest or for the official functions, and the task or function has a clear basis in law. The information is needed in order to carry out duties under the Local Government Scotland Act 2003 and Town and Country Planning (Scotland) Act 1997 as amended by the Planning (Scotland) Act 2019.

For some activities, we may also need to process more limited sensitive personal information about you known as 'special category data'. Where we process special category information it is necessary for reasons of substantial public interest as set out in Article 9 (2) (g) of the GDPR and meets a condition in Part 2 of Schedule 1 of the Data Protection Act 2018.

We require your information to process your representation made under the Town and Country Planning (Scotland) Act 1997 as amended by the Planning (Scotland) Act 2019. Please note that we are unable to accept anonymous representations.

If you subsequently provide us with information and then do not want us to keep your personal details for this purpose, you will have to withdraw your representation to the LDP.

We get your information from communications with us, for example when you submit a representation (or comments) on a LDP document or when you ask to join our customer database. Unless specifically agreed with you, we will only collect personal data about you which does not include any special categories of personal information about you (also known as 'sensitive personal data'). Information that we may collect will be:

  • Your name
  • Your address
  • Your email address
  • Your telephone number
  • Comments (where you have asked to be informed on the LDP)
  • Limited sensitive data may include the following: ethnicity, gender, health

Your information will be accessed by Council staff who need to do so in order to provide services relating to the LDP. We may share your information with The Scottish Government Planning and Environmental Appeals Division (DPEA) as part of the LDP examination process.

Your information may also be shared and analysed internally in order to provide management information, inform service delivery reform and similar purposes to meet our duty to achieve best value and continuous service improvement.

The Council is legally obliged to share certain data with other public bodies such as Police, HMRC, CSA, Scottish Courts and the Public Ombudsman and will do so where the law requires this and it will be proportionate.

We will securely destroy your personal information within 5 years after the adoption of the plan.

Should you wish this statement in another format or to be kept informed about the LDP you should send an email to LDP@eastrenfrewshire.gov.uk giving your contact details to allow us to keep you updated and at any time you may ask for your details to be removed should you no longer wish to receive updates.
